Check local laws for independent contractors to find specifically what qualifies as that in your state. Gather as much evidence as you can, and report them to the I May Live In Texas But On Gameday My Heart And My Soul Belong To Pittsburgh Steelers shirt but I will buy this shirt and I will love this department of labor. Dood. If you have to come on Reddit you already know the answer. Find somewhere else. Then quit with no notice since you’re a contract worker you don’t have to give it. You are 1099 mean you can work when you want. Next time a big project is due, take a few days off. Screw them over. You should turn them into the IRS. The IRS has a hotline for this. They are treating you and most everyone else like employees. They can’t consider you a 1099 contractor if they require you to work at a specific location. Companies illegally paying employees via 1099 is an area that the IRS loves to bust employers for. This will nit harm you in any way. The employer will be responsible for both sides of FICA and Medicare. That’s 15 cents for every dollar they paid via 1099. There are also penalties and interest. There will also be employer state taxes and penalties. You and everyone affected would recover the extra portion of payroll taxes you paid via 1099 as well. Microsoft got busted for this and it cost them billions of dollars. I would suggest you start looking for a new job before you do this. The IRS will not tell them it was you. I am an accountant and have been on the company side of a mess like this. The IRS doesn’t mess around either. I believe you can earn a percentage of what they recover from your employer as a whistleblower fee.
