Easy: you violated the Clemson Tigers Nation One Nation Under God 2023 Shirt and I love this company’s attendance policy so you just don’t have that 8 hours of PTO any more. Now you’re just being paid for the hours worked. I think to make it legal, the company has to pay off the government. They are cheating the government. They are probably going to be OK because they are not cheating the government that much and the government is full of numb nuts and the government is basically on the company’s side anyway. However what they are doing is clearly illegal. They are not just cheating OP but the government. Payroll taxes are nothing to trifle with. The employer is playing with fire. And some states have unpaid wage laws that would sting the employer for 3x damages plus attorneys fees. If you have to work a set number of hours in the office to get PTO and you’re not there, they can take your “earned” hours away and still make you work from home on the clock and the end outcome is the same, as long as that’s their consistent policy.

I’m not aware of any laws in Jersey governing vacation hours, so it may not be illegal. I’d start by combing through the Clemson Tigers Nation One Nation Under God 2023 Shirt and I love this regulations looking for something like that. The correct place to look would be “wage theft” and “earned benefits” laws. These are pretty universal for most states, but i wouldn’t be surprised if texas got rid of em. IANAL. If you’re salaried and are paid your full salary for the week, it is legal. Unless NJ has some special law that I’m not aware of, PTO is not protected. They must pay you fully for that time, but they can do what they want with your PTO. Even though it’s legal, though, PTO IS part of your compensation package, so it’s incredibly poor behavior on their part. Your company sucks.
