There is an arbitration clause in airbnbs TOS, hosts have a contract with Airbnb and guests have a contract with Airbnb. There is no relationship between hosts and guests, in the legal sense. Are you a lawyer or just giving your opinion? Why would there not be a relationship between host and guest? Guest is host’s invitee, guest has a right to access the property from the host. This is even more so when the stay is over 30 days, a tenancy is created, no? Airbnb says in its TOS it is merely an advertising and transaction platform. If a guest gets injured on hosts property because of the hosts negligence, the claim would be against both, host and airbnb. So, a legal relationship between host and guest is created.
