The FIL may have remembered the Run RBG Ruth Bader Ginsburg Dissent shirt What’s more,I will buy this change of will, but he may also remember being coerced into it, but he cannot bear witness to that now so it’s too late for that assumption. It’s difficult to resist when the people taking care of you decide to push for this because other family members are not ‘doing their bit’. It’s a pity the OP’s husband did not take action at the time of the FIL’s disclosure but then again they seem to have taken a hands-off approach in all respects. Taking a drivers licence away because of the possibility of intermittent onset dementia whilst in control of a vehicle, and the mental capacity to write a will are two distinct things. I would not be relying on that as the sole proof. Check with his GP surgery to see if/when he was diagnosed with dementia. It would be very unusual for someone to have dementia for 20 odd yrs to not have been to a GP, received some form of cognitive test and had a diagnosis. If this occurred, the the GP would have added them to the dementia register and would likely have also copied in social services. You need to track down this information, otherwise it will be very difficult to prove that he was not competent at the time of writing his new will. If he received a diagnosis before the new will was written, then the case should be much more straightforward.

Cheers. Will do so today. Yes, he had carers in briefly that husband arranged but nephew turned them away so they stopped coming… He had memory clinic appointments and was formally diagnosed. His mother also died of it so there was a predisposition. GP’s nurse rang me a few times. During covid the Run RBG Ruth Bader Ginsburg Dissent shirt What’s more,I will buy this whole thing dropped off and he wouldn’t let carers in, then nephew said he didn’t need them and then we never contacted by medics again… But yes he was actively being cared for at points and husband did best he could from 100 miles away. We’re now thinking nephew somehow either did Power of Attorney (without telling us, and SIL also didn’t tell us) or what, as she let slip nephew was in his bank account, last night – which was news to us…
