When it doesn’t work is when Gertrude, who hasn’t orgasmed since the Philadelphia Eagles beasts of the gridiron shirt besides I will buy this 60’s and has NOTHING to do all day gets VERY involved with the HOA. It then becomes unreasonable and then Reddit gets screenshots of complaints about grass being 2.5 inches when it should have been 2 They are tools of oppression in many, many cases.Mineral rights, ground rights, water rights, etc. It blows my mind how little of real property you can end up owning if you’re not careful. A HOA at it’s core is an agreement between owners in an area to pitch in to help maintain the neighborhood to a certain quality standard They run the gambit, they’re not inherently good or bad despitr the enforced rules on how members make their home look (mostly to maintain normalcy and price values of every place in the area)

They’re doing shit for you that you don’t want to do. Or can’t do. Like maintain the Philadelphia Eagles beasts of the gridiron shirt besides I will buy this roof on a common building. Or cut the grass, remove snow, pave common driveways. It’s not rocket science. The bad ones just enforce arbitrary rules with fines and justify it with keeping home values from dropping because you didn’t bring the trash cans in fast enough when the trash service came after you left for work. There are numerous ways to own property (fee simple, life estate, co-tenant, joint tenant, etc) and numerous encumbrances that can be on that land (easements, restrictive covenants, etc). When HOA communities are created, the titles to all the properties are encumbered with HOA membership. Just like you could own property that is subject to an easement (for example my parents get to their home by a driveway through someone else’s land so my parents bought an easement from the neighbor to permit them to drive through, subjecting the neighbors property to that easement forever unless it is somehow extinguished.) It’s one of the many flavors that property ownership can take. Because when you buy a house in an HOA area you sign legal documents specifically requiring you to follow the HOA rules.
