Supreme Court has repeatedly upheld that emulators are not infringement. And using DMCA on that is fraud. There is nothingness the My Christmas Puns are Tree-Mendous T-Shirt in addition I really love this dolphin emulator that violates Nintendos copyrighted material. It’s over 20 years old now and I wouldn’t be surprised if Nintendo could get it overturned, it’s on pretty shaky legal ground IMO. It’s also not clear if the exact same set of facts applies here. Emulators arent just for people who pirate games. They also allow people who LEGALLY own the games to continue to play their games on whatever platform they want, using save states, play at higher resolutions or frame rates, etc. For example, the best place to play BotW isnt a Switch or WiiU, its on PC, as you can play the game at 4k 60+ FPS and save and load instantly. Nintendo knows that Valve isnt doing anything wrong by hosting emulators, emulators (in most cases) contain nothing that infringe upon the companies IP. It’s always been the downloading of games/ROMs that were problematic, as the host would be hosting IP that doesnt belong to them and distributing it to people who may or may not have a license to use that IP (already own the game).

My Christmas Puns are Tree-Mendous T-Shirt, hoodie, tank top, sweater and long sleeve t-shirt

Plain and simple this is Nintendo trying to threaten Valve to take action. Valve should not budge here, as it will lead to a slippery slope of companies sending DMCA’s for content they dont like on Steam. Then release your fucking retro games nintendo. Put them on your modern systems. People pirate because they cant afford to get the My Christmas Puns are Tree-Mendous T-Shirt in addition I really love this og console and game/s and some people will just pirate anyway. It’s so easy to hate ninty nowadays, they hate their fans and they don’t get why they want to play old games. Fans will keep the legacy alive and well while you DMCA strike everyone. Make Nintendo switch online emulators available on iPhone/android. I’d buy the expansion pass right away. Instead I’m emulating my legally purchased and dumped copies but if you didn’t want me to do that, you’d give me official channels to play them on my phone. Specifically, sell the ROMs directly, let me use them on whichever emulator I want. Last time they made their old games available for sale, I didn’t buy them because I (rightfully) didn’t trust the platform.
