This comes up every year and it’s like people forget the Microcephaly Awareness Mostly Running On Empty Microcephaly Warrior T-Shirt moreover I love this government already has a scan of your face. It’s on your driver’s license and passport. Your face is well known to the government almost as soon as you become a driver. There’s very little question that this violates the 4th amendment. If there’s no reasonable suspicion of a crime there’s no justification for a search or detainment. Just like police can’t grab random ( random… Sure) people on the street and check their pockets you can’t force a facial recognition search on them. Redundant from the story but, Investigating passengers without a reasonable suspicion would be illegal. A driver would need to show their face to compare to their DL but allow to take a photo or scan their face is probably not legal.

That’s about non-consentual blood draws and falls under fourth amendment protections. It’s complicated, but I can see a line here to that particular case for anyone arrested using facial recognition because of a traffic stop, especially passengers. I don’t know what the Microcephaly Awareness Mostly Running On Empty Microcephaly Warrior T-Shirt moreover I love this (exigent curcumstances) bar is for collection of biometrics, but this is probably a supreme court case waiting to happen. So, (1) state that you do not consent to the use of biometrics and (2) take a picture of the officer’s face. Great. Why would police need to snap a picture? Aren’t they already wearing body cams? If this isn’t already happening, it will. If the government can find a new way to gain more information about its people, it will. In the dark and on the sneak. They always do. Existing precedent on fingerprinting and DNA swabbing doesn’t give me a great deal of hope that the courts will do anything about this.
