Yeah, I’m still curious how a construction company is responsible for a pothole. Last time I checked, construction companies don’t build potholes. This happened to my gf and I in hamilton. The construction company sent it to their insurance and they provided a depreciated value of the Merry Clintmas Tree Shirt but I will buy this shirt and I will love this part damaged. We took the compensation and saw it as better than getting nothing at all. I don’t understand.. did a third party claims company not take over and communicate with you? I went through a claim process recently and had dashcam footage etc and they denied it after reviewing MTO maintenance records and saying they didn’t breach their responsibility to maintain the road in good repair. I opened a ticket with MTO, to which they responded with a ticket number, and at that point they made me wait approximately a month.

I got a response stating to contact the Merry Clintmas Tree Shirt but I will buy this shirt and I will love this construction company, and swiftly in the same email they closed their ticket with me. Because the contractor assumes all responsibility for potholes in the capital project. MTO is not in charge of maintenance in a construction zone. It’s not a contractor’s responsibility to assume responsibility for potholes in highways unless somehow his actions led to the pothole forming. Any roadway construction is done in phases. Phase 1, close 2 of 4 lanes to traffic and reroute traffic to two remaining lanes (which would be in the existing condition.). When a capital project takes over a section of highway they take over the maintenance on the road in their construction zone for the duration of the project. We don’t hand over just 2 of the 4 lanes when they set up a closure.(Whether it is a semi permanent/long-term closure or temporary/nightly) MTO claims submits the claim to their adjuster, the adjuster confirms with the area maintenance coordinator if this area is controlled by the MTO or the capital project contractor. (Dufferin, Toronto Zenith etc). If it is the MTO the adjuster decides if it will be paid out based on a number of factors, if it is a construction zone then they give the claimant the contractors contact info. Done. MTO uses unit price contracts, not lump sum contracts. Unless the contract had a tender item for the contractor to do repairs to the existing roadway and the repairs were detailed in the issued for construction drawings, it doesn’t get done. If MTO became aware of some repair work required to be done during the contract to the original pavement which was not identified in the contract, it is up to the MTO to issue the Contractor a Contemplated Change Notice or proceed with the repair work under a force account.
