I would say you should contact John Lewis and let them know about the I’m not perfect come from Kamo same thing shirt but I will buy this shirt and I will love this error, make it clear you were denying the parcel and that it was a mistake. Can you tell the delivery guy is holding the package? If so, surely that confirms what you have said, otherwise you’d be holding the package. You’d be amazed at what these couriers get away with in terms of photos. I have an arrogant prick of a Yodel delivery driver in my area, and when he delivers a parcel, rather than taking a pic of my hands holding the parcel, or if it’s a large parcel, it resting on my wheelchair footplate, he aims the camera at my face and goes “smile!!” every single time. It’s infuriating and I keep telling him that I do not consent to him photographing my face, but he keeps on doing it! I hate it so much, I now dread every time I get an email saying that my parcel has been dispatched with Yodel, it makes me so anxious. I get them making photo with my hand or even lower torso. But ‘smile’ would probably make me loose my shit lol.

There’s no actual evidence of you having control of the package in question. The picture is not of you holding it. Report this to the delivery company. It’s with pointing out the picture as you’ve described it doesn’t show the parcel in your possession; it only shows that you opened the door while the parcel was in his hand. If it’s been left with you, the photo should show it inside your door and on the floor, signalling that you have accepted it into your premises. It wasn’t. It was in the couriers hand. He could have been asking you for directions to the right address. The photo is not proof of delivery. It’s proof that he came to the right house, not that he handed it to you. Not a lawyer / attorney / solicitor- If they sue you, just be honest about denying the delivery (the delivery folks should have some form of documentation as to where the package went), AND in return, sue the upstairs neighbor for libel / slander, defamation, and anything else possible. Go on the attack viciously, burn that bridge, bulldoze the debris into a pile, and burn it all again.
