They only lost some of the concrete itself. Not hundreds of thousands of dollars of damage. So instead of peaceful strikes you’ll have violent, illegal ones. Or you’ll just have mass walk-outs where everyone quits. Add this to a seemingly endless list of awful rulings by the SC which could have been prevented if only more liberals and moderates had gotten off their fat asses in 2016 and went out and voted. This was an 8-1 decision. Even if Clinton had won, it most likely would have been decided the same way with a few more liberals on the court. The title is a bit misleading. The Court ruled that the right to strike is “limited by the requirement that workers take reasonable precautions to protect the employer’s plant, equipment, or products from foreseeable imminent danger due to sudden cessation of work.” Here, the employer, concrete company, alleged that its truck drivers (union workers) showed up to work, filled up their mixer trucks with concrete, and then drove off to deliver the concrete to customers. During their route, the Union called for a strike and directed the truckers to stop delivery and return to the yard. A few truck drivers did return, but others allegedly abandoned their trucks. The employer alleged that leaving concrete in the trucks’ rotating drums would not prevent the concrete from hardening indefinitely, and there was a serious risk that it could damage the trucks. In the end, the company was able to scramble to find the trucks and dump the concrete out in a safe manner and prevent damage to the trucks, although the entire batch of concrete for the day was lost. The company sued its truck drivers in state court seeking damages under state law tort claims of conversion and trespass of chattels. The state district court (and eventually the state supreme court) held that the company’s claim was preempted by the National Labor Relations Act (NLRA – federal law) because it involved a strike (meaning they couldn’t recover under state law).

The Supreme Court reversed the Dr Seuss I Will Support Dallas Cowboys 2023 shirt But I will love this state supreme court’s decision, holding that the conduct here was not protected by, or even arguably protected by, the NLRA because workers have a duty to take reasonable precautions to protect employer’s property from foreseeable imminent danger due to sudden cessation of work. Obviously, this doesn’t mean that the Union/truckers are liable necessarily, merely that the company may pursue its state law claims (i.e., not preempted by federal law). It should be pointed out that neither the Union nor the employer dispute the “reasonable precautions” limitation on the right to strike under the NLRA, and in fact that is the National Labor Relations Board’s (NLRB’s) position on the matter as well.
