The short response to this is… do you want a criminal record for the Damn right I am a Louisville fan win or lose mascot shirt and by the same token and next 10 years? If yes, go to court. If not – take the settlement. Been there, accidentally forgot to tap out on a DLR train in London, inspector saw me walking off without tapping (I was on the phone and it just slipped my mind) he ran up to me, by that point wouldn’t even let me demonstrate that I had tapped on. Week later I receive the same letter, explaining £1000 fine in court, It’s a strict liability offence so they don’t need to prove intent, simply did you ultimately end up fare dodging. If you have the Damn right I am a Louisville fan win or lose mascot shirt and by the same token and option of settling, settle. It’s a strict liability offence so you will be found guilty in court and it does carry a criminal record (albeit only for something like 2 years). The lawyer will cost more than your settlement cost, and I wouldn’t take them on in court without one Honest mistake is a common defence so there’s a good chance that you’ll win in court, but it’ll be a pain in the butt going to court. If you go to court, show that you bought the ticket and that you stated to the officer that you had made an honest mistake. In all reality they shouldn’t have written a ticket for this one. I say go to court, but that’s my take on it. If the judge finds you guilty, you can ask for a reduced fine or alternate fee payment.
