It requires a written agreement that sets out clearly what is being agreed upon, and both the employer and the employee have to agree to those terms. The employer is also required to provide the most up to date copy of a document prepared by the Director of Employment Standards that outlines the rights of employees and obligations of employers under the hours of work and overtime pay provisions. A union contract can supersede this though, so it’s entirely dependent on OPs union agreement whether or not they can work more than 12hrs.
