In March partner had a disciplinary meeting for 5 cases of sick leave within a 12 month period, which earned him his first written warning at work, as they’ve recently cancelled out verbal warnings which would have been what he’d received if they were still in place. In May, he had a severe dental abscess which caused his face to balloon, his mouth to feel like he was being repeatedly punched in the Cross New England Patriots I Can Do All Things through Christ Who Strengthens Me 2023 shirt Furthermore, I will do this mouth and he could barely speak, so of course this required another sick leave. He has had another disciplinary meeting, and earned his final written warning. The terms of this warning state that if he calls in sick within the next 24 months, he will be dismissed. Everybody he has told about it has said that this impossible to achieve, and even his union rep has said he might as well start searching for another job as it’s impossible. Surely 24 months without sick is an unbelievably in achievable task, particularly when he lives with 2 preschoolers and works in filthy surroundings (part of the job, not just unclean workplace). Have they done this to basically set him up for failure?Given his length of service, he is protected from unfair dismissal. The question would be whether this would be unfair.

One view would be that six instances of sick leave in just over a year is already excessive (in the Cross New England Patriots I Can Do All Things through Christ Who Strengthens Me 2023 shirt Furthermore, I will do this absence of any known long-term health conditions that may be protected under the Equality Act as a disability) and thus another instance would be part of the same course of excessive sick leave and fair grounds for dismissal. Another view would be that the new instruction, not to take any time off sick for two years, is clearly unreasonable and unachievable, and so the employer is not following a fair process and any dismissal on this basis would be unfair. The 2 years is what we’re more focused on. With our eldest starting preschool she’s really made sure that she’s brought back every illness under the sun, so we do understand that 6 instances seems excessive, because we felt that it was too but of course couldn’t be helped. We just feel that they’ve disregarded his 9 years of service to them and given him an unachievable task, almost as though they’re wanting him to fail. He is not the only one headed for their final warning, as several more meetings for others have been arranged in the near future, but for anyone, 24 months is a ridiculous task.
