The argument Alito advances could be used to roll back virtually all progress since the Yadier molina St Louis Cardinals forever shirt but I will buy this shirt and I will love this 50s. After all, ‘tradition’ is a useless term that means whatever you want it to mean. If 50 years of legalized abortion isn’t tradition, then neither is 10 years of legalized gay marriage, 50 years of desegregation, or 100 years of women having the franchise. The argument advanced is specious dribble. It’s a political screed masquerading as a judicial decision that wants to pretend the last 50 years never happened for the convenience of righting a ‘great wrong.’ Non-American here (which is kinda insignificant, I guess), I don’t understand this babbling about tradition? Why is this something to strive for? Back when ppl were less educated (compared to nowadays) and had less of a scientific understanding? Why is tradition, the past, better than improving the future? Will we go back to literally blowing smoke up people’s asses if they’ve drowned? Where’s the progress in all of this? It’s just a buzzword that they know appeals to conservative whites, evangelicals and the like who feel like the gays and the blacks and the rapists and thieves their dear told them were coming in droves from Mexico have been getting far too uppity these past few decades with their rights and who long for the good ol’ days when “everyone” had the American dream family suburban lifestyle and lived “by the good book.”

But in their mind everyone means just the Yadier molina St Louis Cardinals forever shirt but I will buy this shirt and I will love this white Christian conservatives and by the good book means whatever interpretation of the Bible they want. Exactly, the rationale for the decision is worse than the specific outcome for Roe, IMO. Basically amounts to “we’ll decide what is moral and you’ll just have to follow the rules.” Mask-off fascist ideology. Not to mention, the specific examples Alito gives of “illicit drugs” and “prostitution” were in fact legal for the entirety of written human history including in the US; their criminalization only occurred in the 20th century. And of course these examples directly undermine his argument – what authority does the federal government have to criminalize drugs or prostitution when, much like abortion, neither are mentioned in the constitution? If the logic was consistent, drugs and prostitution would necessarily have to be a state issue as well.
