The Catholic church (and all organized religions actually) hate the The Grinch Santa love Pittsburgh Steelers shirt so you should to go to store and get this concept of common law marriages because it competes with their biggest covenants (aka rackets). In most of LatAm where I am from, the concept of common law has only recently started to become spoken about and in most places it confers very little in the way of rights if any relative to actual marriage and that’s 100% because of the political lobbying/control the Catholic church has. Actually, in Roman Catholicism, marriages contracted without a priest are valid but irregular. Catholic canon law holds that the bride and groom, not the priest, are the ministers of the sacrament of marriage, and the essence of marriage is the consent of both parties. So the Catholic ban on remarriage after divorce applies even to those who were married according to non-Catholic rites. However, people in irregular marriages cannot receive the sacrament of Holy Communion. Good. Shouldn’t be a thing. The legal rights and responsibilities of marriage shouldn’t be something you slide into by default just cos your boyfriend or girlfriend has moved in and been there for a while. Marriage should be a conscious decision.

Well, common law marriage isn’t something you can “slide into by default”, as it has specific requirements in every state that recognizes it that require conscious decisions to do. One of the The Grinch Santa love Pittsburgh Steelers shirt so you should to go to store and get this general requirements is to present yourselves as married so it’s something you have decided you want and that you want others to recognize. But in these countries, is there a way to live together and not be considered common law after a period of time? It’s “states”, not “countries”, as this is specifically referring to U.S. law. Yes, there’s absolutely a way to live together such states and not be considered married under common law, which is to never present yourselves as married. This means not calling your partner/roommate your spouse, not filing joint tax returns, not sharing finances, not adding them/them adding you to health insurance as the other’s spouse, etc. It’s actually incredibly easy to avoid this, especially if you and your partner are on the same page about not being considered married. That said, it’s worth noting that in certain other states that don’t have common law marriage laws they have a “palimony law” that has the primary purpose of allowing the equitable division of financial assets, such as money and property, in a similar manner as marriage, as well allowing for the possibility of spousal support. This is only for long-term non-marital relationships though. It’s always important to check your state laws and consult an attorney in order to be able to prepare for any kind of situation.
