They talked about it a couple times yeah its taken care of. You’re all set. I would start going to the house, with your key and move the stuff you want out now. He’s your father and it’s your house now. You and your brother need to stake your claim and show his siblings that this belongs to you, not them. Be mean, be rude, be forceful. You aren’t asking them for permission. This is yours. In terms of a will, I’d say he most likely doesn’t have one because I’m sure your aunt would have already stated that. And if he does you could try to say that he signed it under duress or was too incapacitated due to his alcoholism to know what he was signing away. My gut feeling is your aunt didnt have a will drawn up. I’ve seen this happen with families before though, and it’s usually always a power hungry aunt who thinks everything she wants done is right then turns things ugly when her wishes aren’t followed. But in my opinion, not a legal one, I’d start sleeping there one night a week. I’d change the locks now and I’d go to your father’s bank (and look for any disability, retirement, stocks, bonds, life insurance, etc) and try to get all that sorted out once you can get a death certificate. I’d go about this as if you were both promised the house from birth, that you aren’t going to give it up and now that your father has passed away you and your brother are now the ones to talk to if one of his siblings needs something in the home. I’d get security cameras and have them send you alerts right to your phone too. One last thought, don’t let them use your guilt as a tool against you. You have nothing to feel bad about. Just because they had better relationships with your father at specific times doesn’t mean they’re somehow entitled to his things more than you. Good luck and it’s fine if mods need to delete this.
