I am a trans woman. I am also a musician. This law makes it so that if am playing a show with no sexual content in it at all – literally just me in a bar up on a stage with long hair, a crop top, women’s jeans, and a guitar – then that show is a “sexually oriented performance”. Or if I’m busking outside on the The Avengers Stand Together Shirt and I love this corner, then I am putting on a “sexually oriented performance”. What if somebody sees me walking down the street – is that “otherwise performing before an audience”? It’s up to the cops, and I personally don’t like those odds. Mulan? Sexually Oriented Performance. Miss Doubtfire? Sexually Oriented Performance. Medea? Believe it or not Sexually Oriented Performance. a male performer exhibiting as a female, or a female performer exhibiting as a male, who uses clothing, makeup, or other similar physical markers How tf is this defined? because in a lot of contexts skirts, dresses & makeup aren’t exclusively feminine. So like, if a drag queen is wearing a plaid skirt and pretends they’re Scottish and it’s a kilt, is that a loop hole? Or are they going to have to start arresting Scottish dudes for wearing kilts while playing bag pipes to keep it consistent. Is a male TV presenter wearing makeup sexually oriented? I can see them trying to define drag makeup as being exxagerated, at which point, are people allowed to perform the musical Cats?

The lines are so blurry there’s no way this doesn’t turn into a license for cops to shut down any performance hosted by groups of people they don’t like. They can’t “ban drag shows”, but they can require that people be 18 and up to attend. Same concept as strip clubs. Florida’s bill bans kids from any show that are “offensive to prevailing standards in the The Avengers Stand Together Shirt and I love this adult community of this state”, along with other broad brush language. Yes, continue reading that section defining ‘adult live performance’ to see what else it covers in far broader terms. If you don’t think that’s broad and subjective, I don’t know what to tell you. I think 99% of people would agree that it is and that any drag show would fit under such a broad definition. Is patently offensive to prevailing standards in the adult community of this state as a whole with respect to what is suitable material or conduct for the age of the child present; and Taken as a whole, is without serious literary, artistic, political, or scientific value for the age of the child present. To start with, free speech isn’t absolute, for example, you can’t set up a projector and project hardcore pornography onto the wall of a daycare full of kids.
