Hope we can get some advice. About 20 years ago it became evident my FIL had dementia. Then it became very evident. He was widowed before this and my MIL and FIL had always said they’d made a will to split everything evenly between their 2 kids, my husband and his sister. Once (around 6 years ago) husband visited and FIL burst into tears and said, “I did a terrible thing” – direct quote – and told him he’d cut him and my SIL out of the The Abominable Music Of The Night Dr. Phibes’ Melodic Mayhem T-Shirt But I will love this will in favour of our nephew. Fair enough you’d think, but – at this stage he had dementia. Husband wasn’t even sure he’d done it at all. Yesterday she rang and said she’d arranged FIL’s cremation. No funeral. Nothing. Nephew is moving into his house and she says she has seen the will which leaves everything to her son. FIL loved driving and husband was instrumental (around 6 years ago) in making sure his GP removed his driving licence before someone got killed by him. FIL never forgave husband for “stopping me driving”. We will try and check dates today but we’re fairly sure he was being driven around by my nephew 6 years ago.

Which may mean the The Abominable Music Of The Night Dr. Phibes’ Melodic Mayhem T-Shirt But I will love this sole beneficiary drove him to the solicitor’s office to change his will… Drove him because he had dementia to the point he’d lost his driving licence. Also just discovered nephew (who has a criminal record) had full access to FIL’s bank account for… the past 6 years. Husband headed off at the pass when he enquired about getting Power of Attorney. Police matter? And can we contest the will without a solicitor? (Can’t afford one).Your option would be to contest the will, on the basis that your father in law might have lacked mental capacity at the time it was entered into. There are many solicitors that deal with that sort of work and they will be able to advise you further.
