My point on mitigation would be that the debt only became due because of the breach. So I open the door, you don’t give me the £50 upfront fee. At this point there is a breach of contract, I have a common law duty to mitigate my loss and it would be reasonable of me to stop listening and close the door. It would not be reasonable to allow the breach to continue and then try to recover an hour of time when I could have stopped my “loss” as soon as I was aware of the breach occurring.

I agree with you if it’s a claim for damages but I think (I’m a private equity lawyer so I don’t actually know any law) debt claims work differently. There’s no duty to mitigate at common law but you can’t claim damages for a loss that could have been avoided if you did motigate. I think it’s the same reason why landlords can sue for unpaid rent without having to mitigate by bringing in a new tenant.
