Neighbour has apparently been told during sale that the Slipknot Death March Shirt so you should to go to store and get this area in Blue circle can be used for parking their visitors’ cars. Note that visitor parking spaces for the estate are clearly marked in color on the full site plan. Since random people started parking their cars in the Blue circled area, I started parking my car there to discourage people from parking there. Neighbour just requested us to move our car so his visitors can park there. I probably wouldn’t mind it but the space looks directly into our living room bay window. Also, the space is at an elevation compared to our living room. It feels very uncomfortable when random people park there and walk around. Thats the only ventilation to the room & we like to keep it open. Also allowing random cars to park there will only make more people think its a common space to park.

I explained this to the Slipknot Death March Shirt so you should to go to store and get this neighbour & offered him our parking spaces when needed. But he still felt he has a right to park there & checked with the customer service and apparently been told again that he ‘can park there’. I showed him the above definitions in the deed and that he can only pass through the section of the shared driveway and nothing else. His arguments are: We finally agreed to disagree & he accepted the offer to use our space when needed. I understand his discomfort in having to request me for space everytime especially when he thinks he has a right to park in the said area. But I feel he has no right to park there but I was fair in not wanting people using the space offering our parking space. Who is right here?As the blue circle falls within the boundaries of your property a specific right to park would need to be reserved over the land. This right would noted on your title register and the neighbours title register too as a benefiting right. Unless it’s written in the deeds it doesn’t matter what some builder has said as they’re not a trained legal professional. A right not to park doesn’t need to be specifically derailed within the deeds because the blue circled land is your demise and you have the right to exclude all others. I would not recommend allowing anyone to park anywhere within the boundaries of your land incase the try to claim a prescriptive easement in future.
