Therefore it would be their fault, unless you’re drunk there could be no other offences towards you. North america here In the UK, it’s the drivers responsibility to make sure everyone has their seatbelt on, otherwise you’re the one who gets fined. Tell her that and say that you’re not going to drive her again unless she wears a seatbelt. If she takes it off, just pull over until she puts it back on.

Accidents happen, and often, there’s absolutely nothing you can do about it.
