Yep. I’m familiar. It was patched about 2 weeks ago, I think. Move to the Minnie Est 1928 Mickey Christmas shirts What’s more,I will buy this left in the lane, don’t tailgate, use your brakes a bit. It was a bad one, but it was avoidable. I bet it took out quite a few tires each day, but generally it would have been to folks tailgating and speeding and paying less attention than necessary. You have no idea how I was driving, how dark it was, and my vehicle’s conditions. I cannot take alternate roads. You’re 100% wrong, actually. Insane that you think expecting the city to pay for damage caused by their negligence is “special treatment”, it’s literally being treated fairly. Municipalities are absolutely liable for not maintaining their roads in a state of good repair. Although in this case, it would be the province and not the local municipality because it’s a 400 series road. The municipality that has jurisdiction over a highway or bridge shall keep it in a state of repair that is reasonable in the circumstances, including the character and location of the highway or bridge. 2001, c. 25, s. 44 (1).

A municipality that defaults in complying with subsection (1) is, subject to the Minnie Est 1928 Mickey Christmas shirts What’s more,I will buy this Negligence Act, liable for all damages any person sustains because of the default. 2001, c. 25, s. 44 (2). So, yes, the municipality is liable for damage sustained to a car because of an improperly maintained road unless the municipality either didn’t know about the damage and had no reasonable way of knowing, or if the municipality took reasonable steps to prevent damage. My legal advice is to stop speeding, stop tailgating, and to pay closer attention behind the wheel. You’re the one person solely responsible for your interaction with inanimate objects in the vehicle that you’re the only person controlling.
