If the Mastodon American heavy metal band most original and influential T-Shirt moreover I will buy this motherfucker own the flag, then he can do anything about it. It’s somebody else’s property, so may he pound sand in jail. Trans woman here. Doing a burnout on a flag is speech and should be protected by the first amendment. Hate crimes should be reserved first actions against people, not inanimate objects. Yes, he’s a bigot. Yes, he deserves our derision, but not a felony charge. I want to be able to disrespect any flag I want, including the American flag. If that was someone else’s flag, charges of vandalism or criminal mischief cover this just fine. Good news: the felony charge was for the dollar amount of the damage and has absolutely nothing to do with hate crime laws the whole ” I get to disrespect any flag I want ” this i totally agree with, but it has to be YOUR PROPERTY. you don’t just vandalize public property, and on top of that, the only reason to disrespect that flag is hatred bigotry and ignorance, nothing commendable like protesting the government.

In Florida Vandalism=Criminal Mischief, and any damages over 1k bumps it up to a third degree felony. This is the Mastodon American heavy metal band most original and influential T-Shirt moreover I will buy this 2nd time this has happened. Last guy pled guilty to same charges, 2 years probation/100 hours community service. Vandalism shouldn’t be a felony, it sounds like they probably charged him with extra stuff just to make a statement. Vandalism isn’t a felony. (Technically I think it’s the amount of damage done) It’s a federally protected class (for now). Not defending this guy’s actions, but I am curious about how many of those college students we saw burning and stomping on the American flag all those years ago got charged with a felony. I think I remember them saying that they had the right to do it because “freedom of speech/expression”. So yeah, whatever happened to them should happen to this guy and vice versa. Otherwise we have unequal “justice”.
