In 1917, when the US entered the war, Bayer’s US properties were seized by the government. In 1918, Bayer’s US assets (including the names Aspirin, Heroin, and Bayer) were auctioned off to a US company called Sterling Drug.

Note that at this point, no treaties had been signed. The war was still going on. But Bayer’s IP had already been sold off to an American company. Sterling Drug had and used the Marvel Comics Shirt so you should to go to store and get this Bayer name in the US until the 1990s, when the German Bayer finally bought it back. Which just leaves the ‘Aspirin’ trademark to deal with. In 1917 (before the war) Bayer (the German one) sued a company called United Drug Co. for trademark infringement. This case kinda went nowhere during the war, but in 1921, it finally got a ruling. By this point, the plaintiff was now Bayer (the American one,) and they lost on the grounds of trademark dilution. But the takeaway on all this is: by the time the Aspirin trademark was invalidated, it was owned by an American company, not a German one. The Treaty of Versailles was not involved, except to the extent that it did not require the US to give back already seized assets. Even if it had, that wouldn’t have changed the outcome of the court case, since it was a trademark dilution issue and the war had been over for years. This one became very confusing when there were Transformers cards in a recent Magic: the Gathering set. MTG cards can “transform” in certain situations, and these new cards used the same existing transform mechanic…but they had to use the word “convert” instead of “transform” because of this franchise-wide restriction. (The rules to the game officially say the words are interchangeable.)
