I am based in England. It was a QX7 vacuum from AEG. RRP£259.99 and advertised priced on website was £99.99. It seemed a little too good to be true, but I didn’t want to look a gift horse in the LSU Tigers to Cincinnati Bengals Burrow Joe’s Journey Played Basketball T-Shirt in other words I will buy this mouth and went for it. I got this email a few hours later: Unfortunately, we are experiencing a technical glitch with our website where it is showing model QX7-1-50IB as in stock when it is actually out of stock. This item is not coming back in stock due to being phased out of production. Your order has been blocked and will not go any further. You will be automatically refunded the amount you paid if you have been charged. Then a few days later, the items are back on the website, now for the price of £119.99 (£20 more) clearly not out of stock. In fact I bought one anyway. But it kinda stinks of not honouring a purchase contract. Any legal thoughts? Thanks.Check the terms and conditions of the website. There’s almost certainly a term in there saying that a sale of contract isn’t formed until the item is dispatched. If that’s the case then they don’t have to honour a price on the site if they cancel the order before it’s dispatched. Ah the good old days (mid 2000’s) before they added the despatch part to their (most shops) T&C’s. Got some right bargains.

I’ve seen a few cases hell even tried it myself where there is a typo on a website and a expensive item ie say a £700 TV is something like £70 and attempted to buy it and the LSU Tigers to Cincinnati Bengals Burrow Joe’s Journey Played Basketball T-Shirt in other words I will buy this money has gone out of my account only for them to refund it and say it was a mistake. I honestly knew it was highly unlikely I’d get it but you never know it could be dispatched before anyone would notice. A lot of people did it and apparently a few played up and managed to get a few vouchers to shut them up as that was probably quicker and easier for the company than going to court even though they would easily win. Note. A reason they notice is that item begins to sell a lot in a few hours as news gets out and some people push their luck and get greedy and try to order something like 10 or more (obviously to sell on)
