McDonald’s is challenging a 9-year-girl to a game of legal one-on-one over the ownership of the phrase: “Nothing but net.” Joanna Amron, 9, of New York, patented a basketball game on Nov. 17, 1992, that she had created for a national invention contest. She received approval for her trademark on the expression in August ’93 and a deal was made with a company to produce a line of basketballs. Meanwhile, McDonald’s introduced its ads using the phrase on Jan. 31, 1993, and eventually offered Joanna $10,000 for use of the trademark before taking it up in court. The legal contest continues because newly approved trademarks can be challenged. There was an entire ad campaign where Michael Jordan and… Larry Bird, I think? They basically kept coming up with wilder and wilder banked shots that had to end in “nothin’ but net” and the loser would have to get the winner a Big Mac or something. He does Taco Tuesday on his social media a lot. I don’t know if the dude actually thought he invented Taco Tuesday or wanted another revenue stream. Gregory’s Bar in my hometown of Somers Point NJ owned it before any of them! And they gave it up last because the legal fight wasn’t worth it against Taco Bell. But Taco Johns had to accept exempting NJ from their exclusivity for decades due to Gregory’s having it first.

Yeah, in the late 90s I worked at Sears and all of the phones had a quick call labeled Nintendo that rang the phone next to the video games. A company in Australia was sued by an American company called Ugg Boots because the Australian company was selling boots using the name “Ugg Boots”. They wanted the Australian company to cease using the name and IIRC a stupid amount of money. Completely ignoring the fact that “Ugg boots” has been a generic name for fur boots in Australia for as long as I can remember (and likely even longer). Escalator is especially interesting, because the verb “to escalate” comes from the brand, rather than vice versa.
