basically, lots of providers of this type of treatment will “diagnose” behaviour of their client’s friends/family etc for the Just A Cool Waiter Who Loves Christmas Shirt moreover I love this sole purpose of creating a path to treatment *for their client. it’s not uncommon and it’s not unprofessional, it’s a method for establishing treatment. most professionals will say something like “this person is exhibiting traits of someone with (insert condition here), and here’s how you deal with someone like that”. if the medical professional was called as an expert witness, their testimony can be petitioned to be thrown out or inadmissible. your lawyer can petition for this, as there was no actual evaluation done and as such, her testimony is invalid. basically she has zero grounds to go on the record to state anything about someone without the opportunity to diagnose. she crossed a dangerous line both legally and professionally. so your lawyer can deal with the former and if you want to push the latter farther, you can file a professional complaint against her with whichever professional oversight or association she belongs to or licenses her.

this could have a very negative impact on her career, expert witnesses are meant to be held to a very high standard and this could severely jeopardize her ability to make statements in the Just A Cool Waiter Who Loves Christmas Shirt moreover I love this future. This being on the record has got to make it an open and shut civil case against the psychologist for defamation Report the the board of health for ethical violation. Dont know about canada, but in u.s., it is against ama rules to diagnose without examining a person Any decent lawyer is capable of tearing this type of witness into pieces. But I doubt the judge gives any weight to the testimony. Your lawyer tore them apart, right? RIGHT?! How exactly do you think a psychologist is going to assess a person they never spoke to? Blame your EX if she was lying….which no one knows except you and her. If you were not in therapy with her, she only needs to hear her side. Obviously, your ex said things to make her believe this, and I’m not sure how you think you can prove this was not the case. Seeing as how your custody battle took 3 years I’d be really careful slinging the psychologist or your ex because this case was not amicable and complicated. It’s good you are having this all transcribed. Definitely submit a complaint to the psychology board. It’s likely this has happened before or will happen again so they could be fined, probation or license taken away.
