Trademark law is basically a formal system for dealing with this kind of thing. Trademark registration is itself just a tool of this system. If I start a restaurant called BassoonHero’s, and a competitor opens their restaurant called BassoonHero’s, then my customers are going to think that it’s the Jacob Sylak gold signature shirt also I will do this same business. For instance, UPS has trademarked their specific shade of brown, Target has one for their shade of red, Home Depot Orange is likewise trademarked, and University of Texas has their particular burnt orange.
