I used to live in Indiana. I’m not surprised that she did this. I’m also not surprised that she completely missed. If I saw I hate Jews and I plow a truck purposely in to a group of people I think are Jews, and they turn out to not be Jewish, like…that changes things? I feel like the Jacksonville Jaguars We Are All Duuuval Shirt also I will do this intention matters here. It’d depend on how strictly the statute is written. I’m not familiar with Indiana’s hate crime statute, but it’s entirely possible the crime has to be committed against the minority group in question to be legally considered a hatecrime (for prosecutorial purposes). Seeing as she ran her car into anti-semites, the intent to commit a hate-crime would be there, but the crime itself would lack an essential element as she harmed anti-semites rather than Jewish people. The potential problem you’d run into here is that the Jacksonville Jaguars We Are All Duuuval Shirt also I will do this victims whom this woman drove the car into are not Jewish and are, in fact, anti-semitic (which her lawyers would be desperately clinging to very, very intensely). All that said, “perceived characteristic” seems sufficiently broad enough I could see a case being made against her and holding up (since she thought they were Jewish, so…). I’d say it fits, personally, but I’m not a lawyer/judge so. Yeah, my thought exactly. It’s gonna come down to lawyers but I love the thought of it working how I’d like it. The person committed the offense with bias due to the victim’s or the group’s real or perceived characteristic, trait, belief, practice, association, or other attribute the court chooses to consider, including but not limited to an attribute described in IC 10-13-3-1.
