There also was a firm medical diagnosis of dementia, which presumably will be on the medical records. We are not certain when this finally came, but feel fairly certain it was before this date. We’ll go back and double check some dates.

Yes, I get it that people (and their wills) change. But I’m assuming once someone has dementia they shouldn’t be changing their will. Realising that moment of lucidity when he was crying his heart out because he’d cut husband and SIL out, does make me wonder. I said to husband last night you have to remember that wasn’t your dad doing that. That was your dad when he was ill. So it wasn’t literally his “will”. He had years to cut husband out after MIL died and before he got dementia – and when still compos mentis, he didn’t. A diagnosis of dementia doesn’t automatically mean a person doesn’t have mental capacity. By law this is determined via an assessment. Was a formal mental capacity assessment carried out prior to the will being changed? A diagnosis of dementia won’t automatically mean somebody can’t change their will. I can find that out, if the GP will tell us, is the answer. I know he’d had various assessments but precisely which ones and when I don’t know. My husband attended some hospital appointments with him.
