I am not sure I understand the It’s An Oy Vey Day Shirt in contrast I will get this logic behind this ruling then. Following this reasoning, wouldn’t any skill test have the same issue ? I mean, sure, IQ tests would filter people with lower education, so disproportionately poorer comunities, but that’s a racial bias in the same way firefighter’s entry tests are gender biased. The intent of the test is to filter on specific criteras, and it’s doing just that. If someone want to complain about the results, then it would make sense to fix education and wage disparity, not to put underperforming people in potentially dangerous roles. This is the same reason that black Americans get preferential college enrollment with lower test scores, because they tend to score worse.

The problem is that we are re-enforcing underachieving in that community and also placing people who will not succeed in college/work positions. Unfortunately, these policies intended to help black Americans actually just hurt them in a different way with the It’s An Oy Vey Day Shirt in contrast I will get this side effect of hurting other people as well. Iirc it’s been a while since I looked closely at IQ tests the way they were designed favours a very specific set of learning with no cultural considerations and so both social background and access to education effect it ethnicity would similarly effect it, not to mention the broad gesture you could make towards social background and race being heavily linked. You might be thinking of those tests that were used to prevent peoples of color from voting. Those were not IQ tests. Those tests are supposed to test your ability to solve problems, memorise data and extrapolate on it. If that’s what you require in the job you want to fill, then I don’t see an issue with filtering on those criteras. By your logic, heavy load jobs are biased against physically disabled peoples, modeling and showbiz jobs are biased against uncharismatics people and military tests are biased against immigrants. Ideally. But it can be hard to judge their competency at that exact work if they’ve never done that exact work before. What are the odds you only interview people who have loads of experience in “job title in this field, using this technology, in this industry, in the specific way we need it done”? And if you do find those people, you never have a full picture of their competency since they’ve not worked for you before.
