I don’t really care about these billionaires seriously, but civil asset forfeiture without any due process regardless of it’s been happening for years is wrong and it incentivizes for profit justice which at a lower level like a local police department can and has been abused. I was wondering about the first question. Like sure, maybe the US could “seize” it in the sense that the oligarchs couldnt bring it back to Russia right now anyway. But is it legal for the US to sell it off somewhere without the consent of the owner? It is technically their property. You’ve said it yourself in the last sentence: assets were seized and returned. There are billions in seized and frozen assets all over the world – From Mobutu’s pilfered fortune to Obasanjo’s and so forth – and they overwhelmingly remain so (frozen), though I suspect that assets held in banks are being made to work for said banks… The question is about the legality of seizing and selling the assets. I think this is a legitimate question that should be able to exist outside the morality of the illegal war in Ukraine. I’m not a lawyer but I’d like to think I sort of know how things work. This, however, has not been obvious to me. The fact that Congress is being asked to facilitate the establishment of a modality to sell seized Russian assets suggests that it isn’t obvious to lawmakers either that the state can simply sell seized assets, normative ethics aside.

Hell, the US seized a shit load of Iranian property during their revolution and only gave it back a few years ago. Please cite a different example of a historical precedent for this. Your Iran example is terrible for two reasons. One, the seized assets were owned by the state, not private individuals. Two, the only reason the assets were allowed to be seized is that countries designated as state sponsors of terror are exempt from the Foreign Sovereign Immunities Act (FSIA) of 1976. At present, Joe Biden has not designated Russia as a state sponsor of terror, so there is no legal basis for the seizure of Russian state assets, and absolutely none for the seizure of Russian citizen assets.
