its also applied to work place, not as frequently…but still applied. But lets say it wasn’t….do you really believe that the I have been ready for halloween since last dog lovers vintage T-Shirt in other words I will buy this driver of a bus, when confronted by a man with a firearm, could have safely retreated from the situation? Even in areas w/o SYG laws, I think most reasonable people would say they couldn’t reasonably retreat, so again SYG is pretty moot. Its not the shooting, its the reasonable fear of imminent great bodily harm or death….someone making threats to shoot you, then pulling out a gun does rise to that level. You don’t have to let someone shoot you before you’re able to legally fire in self defense. shooting someone after they no longer present a threat would generally be considered assault or attempted murder I really think you were trying to go for the low hanging fruit of “SYG states bad!!” but really, this case isn’t a SYG issue. The driver going after the guy after the initial firefight will be the issue, not whether or not he was justified to shoot at the passenger.

Dude, I have so many guns and said nothing about Stand Your Ground being inherently bad. You are barking up the I have been ready for halloween since last dog lovers vintage T-Shirt in other words I will buy this wrong tree for outrage points. You imply very strongly that SYG states allow aggressive/offensive use of force against a person who is no longer a threat. I didn’t though. SYG just says you don’t have a legal duty to retreat before you’re allowed to use lethal force, the other requirements of self defense are still a thing. In this case whether or not the drivers actions are criminal don’t rest in SYG laws but rather or not his actions at some point went beyond self defense and became criminal. He did pursue the passenger at some point and continued firing. The debate on justified or not is fine, just saying that SYG states isn’t relevant …in regards to the other commenter’s statement about “every state except those with Stand Your Ground.” So I was wrong and I retract and apologize.
