See the post for evidence. “Times changed” is not an adequate way to conduct analysis of granting unenumerated rights in the United States. He even states abortion was illegal in over half of the United States at the time Roe was decided, which is not ye olden dayse as you think of it. If you believe this is an adequate way to grant unenumerated rights, then become a judge and start ruling cases as such so you can make it precedent. Until then, stay losing. As to your last point, I don’t even know what you are saying. Notice how you didn’t even answer my last point. If Americans want abortions, they should codify it into law, not have 9 old people on a bench decide it for them. Welcome to the real world. It sucks. Get over it.

That simple. Not so simple for abortions. So the original intent of the Constitution relates to Muskets and the arms of the day. Not to modern weapons. You can’t apply Alito’s use of historical acceptance prior to the 20th century to time travel to a place which makes his position work and then once accepting that move say but it doesn’t apply to anything I want.
