I have been disappointed by the Gta san andreas poster the weeknd shirt and I love this resilience of Roe so many times over the years that it wouldn’t surprise me at all if a last-minute change occurs and Roe survives yet again. It’s been tougher to kill than a tick on a cockroach in a nuclear fallout shelter. Hoping that isn’t so, and I suspect the leaker really is a liberal who is aghast at the ruling and is desperate to change it, but …. won’t rest easy until the official decision is announced. Never had any basis in the constitution. The drafters and enactors of the 14th amendment surely had no intent to protect abortion rights nationwide, the notion is IMO farcical. Roe is just as bad as the “same-sex marriage” decision of 2015, which also wrongly relied on A14. There’s no way the enactors of that amendment meant to mandate gay marriage nationwide, which is why in both cases it took the supreme court 100+ years to “find” these rights in the amendment.

Both are to me pure cases of “legislating from the Gta san andreas poster the weeknd shirt and I love this bench”, judges reading their views of what policies are right or wrong in to the constitution, usurping the political branches. Its not about abortion or gay marriage, or what the framers intended or didn’t intend. Its about the right to privacy, and as a result personal freedom. I think it is about what the framers intended. They enacted an amendment with meaning, and IMO that is what the court should respect. Otherwise we’re just making stuff up and don’t have an actual constitution. Sometimes when a case arises the intent of an amendment or provision isn’t known or is unclear, and then judges can only rely on inferences and the like, but with abortion and gay marriage there can’t be any reasonable doubt. Gay marriage and abortion may well be good public policy or not, but unlike say freedom of religion and the press, the constitution doesn’t mandate federal protection for either. To me it should be up to us through our representative processes in congress, legislatures, etc. to decide about them, as we decide about many other things. If we want to enshrine them as rights protected by the constitution and thus not subject to those processes, then pass an amendment doing that.
