When you can make that point without damage, you are liable for the damage you do make The workers made demands, the company said they were unwilling to negotiate, just keep making concrete. They said they were going to leave but the company said they didn’t care, they aren’t protected by the NLRB until they are on strike, so they followed orders until strike time. It’s not the workers fault the management is short sighted and greedy. Not really. That’s “equipment.”. They were sued over product — the wasted concrete. And, they timed the strike knowing that the concrete (and, they hoped, the trucks) would be ruined. I’ve worked in factory jobs for many years now. Management can and absolutely will twist a person walking off their press to use the bathroom in an emergency if the press isn’t shut down by the actual technicians responsible. You slam that emergency stop button and run off so you don’t shit yourself and you can bet you’ll hear how it would have been better to bury yourself in parts so the machine isn’t damaged by stopping suddenly.

Companies don’t fucking care about you, they care about Product and Tools. This SCOTUS just agreed with that. It’s a baby step into setting firm guidelines for instances you can go on strike (read:none). Pressing the e-stop and going on strike in a situation where you can simply restart the shop is not anything like mixing up an entire truck of concrete and leaving it in the truck to cure so that both the concrete and truck are destroyed. It’s no different than my last job where at any time I could have hit the e-stop button for the conveyor belt on the paint line I worked. The robots that flame treated the plastic before painting (makes the paint adhere to the plastic better) would immediately come to a stop but, critically, they would not immediately cut the flame as it was in an area where no person could physically get to and not technically part of the conveyor. A car door frame could sit there and catch fire, the painted parts in the curing oven would have been scrap after a time and that says literally NOTHING about the fact that stopping a massive conveyor could quite easily damage the gears that move the damn thing. If you think the entire shop going on strike couldn’t have cost the company tools, product and damaged dozens of multimillion dollar machines orders of magnitude more expensive than a cement truck you either haven’t worked in a factory or don’t understand machines. I guarantee the owners of that factory know the risks, that’s why unions are powerful (and why that was a union shop). Walk offs hurt companies more than just labor hours per foot.
