The argument is that she didn’t provide enough personally identifiable information about the Ftr Living Legends Skulls Shirt besides I will buy this patient. Now, in this day and age of all information being accessible all the time, in my opinion, that’s a bit of a naive thought especially once there was a report of a man in Columbus, OH being arrested for raping a 10-year-old in his care who got pregnant. And anyone who personally knows that man can probably figure out who that girl is and now knows that she got an abortion. All that being said, she did something that many doctors already do, i.e. talking about patients in non-specific terms and describing their symptoms, diagnoses, treatments, etc. Her mistake was that this story went viral which isn’t really her fault. It’s the fault of the situation and, partially, the fucking Indiana AG who decided to very publicly go after this doctor because he had egg on his face.

That is incorrect. Health care personnel are free to speak publicly about cases as long as there is no way to identify the Ftr Living Legends Skulls Shirt besides I will buy this patient being spoken about. AFAIK, the only personally identifying information the doctor released was that the patient was 10 and from Indiana, which 1) is not enough to violate HIPAA because there are probably tens of thousands of people who meet those criteria, and 2) is information that the AG had already released. Regarding #2: if the AG had indeed released personally identifying information, I think it would still be illegal for the doctor to subsequently reveal or discuss it. Revealing age alone is not a violation of HIPAA. It would be a violation if the doctor revealed her name, DOB, address, photos of the girl, parents name, etc. Just talking to the press without revealing such protected identifying information is legal. I read on another subreddit the patient can be inferred from the details the doctor gave even with all patient identifiers removed.
