If you are so sure that your side is correct, you shouldn’t have to lie to defend it. Alito does not establish any new bar for basic rights. Alito’s claim is that Roe and Casey failed to meet the bar the majorities themselves invoked, viz. the standards the Court invented throughout the development of its substantive due process jurisprudence. The mention of gun rights and interracial marriage in the editorial is a blatant red herring: these concern a completely different strain of the Court’s constitutional interpretation. (In fairness, the gay rights point holds more water. Even though Obergefell is not only a due process but also an equal protection case, I think there is some legal merit to the view that the due process strain of Obergefell’s analysis might be called into question by SCOTUS as now composed. As a legal realist matter, I don’t really buy it. A big part of the Court’s motivation for striking down Roe is the extent to which it has poisoned American politics. Gay marriage is just not a hot button issue in this same way, and I think there is little appetite to return it to legislatures.)
