Like mf WHAT In California, police cannot arrest for any misdemeanors not committed in their presence except for DUI and domestic violence. The police can only file charges with the DA. If the alleged offense is a misdemeanor, it is common for the law to require that a police officer witness the offense in order to make an arrest. It is designed to protect people from overzealous cops to a large extent. A slap is generally going to be charged as a simple assault, which is probably a misdemeanor. This likely why the DA charged it the way they did – presumably the charged offense is a felony which does not require an officer to witness it for an arrest warrant to be issued. Depends on the state. By me, for a disorderly persons offense (aka misdemeanor) such as this, it has to be seen by an officer, with exception to a few statutes (domestic violence, shoplifting, a couple more). With this case, which is “simple assault”, it wasn’t done in the presence of an officer, so they can’t arrest. What they can do is take a report, submit the camera footage to evidence, and advise the victim to file complaints at court and take the woman to court after she’s identified by police. Then the video will be viewed in court and she’ll be served justice. Misdemeanor offenses are typically only arrestable if observed by an officer. Otherwise, the police must issue a complaint with the court and the woman will be summonsed, which is why the video states that the case was forwarded to the DA.

It’s more likely they weren’t able to identify the Fire on the side book club T-Shirt and I will buy this person. How can they arrest someone if they don’t know who it is? Police aren’t going to spend time and resources trying to find someone who slapped someone. In order for police to make a misdemeanor arrest on the spot, the police had to have witnessed the offense OR the victim can follow them to the magistrate’s office right now to sign the warrant themselves. In your example, stabbing someone is a felony and does not require police to have witnessed it. However, it does take minor investigation, which can be as simple as victim statement, witness statement, video, etc. If an officer didn’t witness a misdemeanor, she cannot base an arrest on what other people tell her happened. For example, if a security guard tells the officer about a store theft he witnessed, or the officer’s only information comes from security videotapes, the offense didn’t happen “in the presence” of the officer.
