It’s truly a commendable feat. Mental healthcare is practically non existent in the US and without consistent access to quality affordable care, housing, food, transportation and educational resources it’s a tight rope walk that most people can’t sustain but why shouldn’t they have to repay if they chose to commit the crime? It should be part of the restitution to the state. I would say that crime, especially the kind of crime that gets punished (as opposed to, say, wage theft), is often as much a result of societal failure as individual decisions. And that means its dangerous, very dangerous, to make incarceration cheap for society. Why bother solving the problem if it doesn’t cost us anything? And on the flip side, if it does cost us, then it might be worth spending quite a bit to solve it. This is a key argument in the move toward the Housing First model of responding to homelessness, for example: it is cheaper to house someone than to have the police called on them and have them repeatedly taken to emergency rooms and jails, as well as being better for the people being housed. It’s a lot easier to argue for the program under those conditions.

And of course anything that makes it harder to get back on your feet after being incarcerated will inherently increase recidivism. Are we most interested in enacting fair punishment for criminals, or in building the best society for everyone? There needs to be punishments for the actual individuals who make these decisions. No more of the nebulous “the government messed up” or “DCFS needs to revisit its policies”. Nope, refund the girl (+with another $10k of damages just because fuck ’em) from the pockets of the worthless bureaucrats that make these awful decisions. Take away their homes, their cars, no one cares I agree with everything except the damages. Should be way higher. I spent a month in a psych hospital as an adult. It was a pretty nice hospital, and I was cognitively fit and able to understand and consent to all treatments, and could leave anytime I wanted, and yet I still have occasional nightmares about being back there, ten years later. Being a presumably terrified 9-year old who can’t contextualize their situation, can’t leave, doesn’t have anyone helping them, that shit could leave some pretty deep scars. I very much hope it doesn’t–kids are tougher than they look sometimes–but god damn, they’ve already been through hell losing both parents, cut them some slack, right‽
