Edit: a lot of conversation here, emotional reactions to the Eddie Guerrerd Love boxing Shirt and I love this state of American policing, some pointing out that lawyers are expensive, some observing that once your biometrics are collected there’s no taking the pee out of the pool. Without getting into a debate on any of these points, here’s my bottom line… You have one life with two choices: live it or sacrifice it. But you only get to sacrifice it once, so choose carefully the hill you (literally) die upon. Is the pride of winning an argument with a random street cop that hill for you? I suggest it would be wiser to live to fight another day. drivers caught in that situation have the right to verbally tell an officer that they do not consent to have their biometrics (in this case, their face scan) collected. That might not mean shit to an officer at the moment, but Wessler said it could help down the line for people trying to litigate over their rights. Winning in court is good and all, but in reality once your biometrics are in “the system” they are there forever.

A judge can order them expunged, then when they use them for a false link to charge you with something down the Eddie Guerrerd Love boxing Shirt and I love this road everything gets dropped due to “fruit of the poisoned tree” doctrine. Third time the cops will be super pissed that they weren’t able to put your innocent ass in jail so they’ll use the supposedly expunged data then use paralel construction lies to make it stick. Make it clear that you do not consent and this is happening without your consent, but do not physically stop the cop from scanning your face Attempt to physically prevent the cop from scanning your face, be this by trying to hide your face somehow, fleeing or attacking the police officer. Options 1 and 2 get your face scanned without too much trouble, but 2 may give your lawyer more to work with if this is somehow used against you later. Option 3 is all about the trouble, and your face probably still gets eventually scanned. Option 3 will always be the worst because they’ll stick a resisting or assault charge on you (and it will stick probably) and they’ll get your face scan AND fingerprints in the end. Well, yes and no. Unless I’m mistaken about the technological capabilities of the biometric database, relief would likely come in the form of a declaratory judgment requiring the information to be expunged from any database, and the court has mechanisms of enforcing that. There’s a question of whether that information would be removed, but that’s another issue for subsequent litigation.
