He sits at a desk and doesn’t need to go into the plant. He parks in a large warehouse type building right by his office door. But it’s not outside the realm of possibility that as a basic requirement of his job, that he may have need or be required to enter the plant? Other commenter above is correct – most construction and manufacturing environments won’t accommodate a situation like this. Even if in theory he can sit at a desk all day every day, one of the basic roles of his job likely requires him to enter the floor at some point if needed – and he can’t do that in a wheelchair. If he had a front office type job, it may fly. As long as his job is tied to supervision of the production (or whatever) floor, he’s going to be out until he can be medically cleared to be able to navigate that area, safely. As the other commenter said, even if this injury isn’t work related if they allow him to return and he re-injures or has some other issue, it becomes a workplace injury and they’re not going to take that risk either. So, his issues are twofold – can’t fully perform the functions of the job, no matter how rarely they’re required – and still poses a liability to the company unless/until cleared by a doctor to return under circumstances where he can perform those duties (crutches, apparently).

I agree with your husband. I broke a bone in my foot two days ago, and have to stay off it for 6 weeks. The dr. suggested crutches, but I know from past experience that they’re awkward, cumbersome, and call for more upper body strength than I’ve got. I’ve gotten a knee scooter and a knee crutch They’re both taking a bit of getting used to, but I still feel MUCH safer using them than crutches. If he’s on crutches, as his boss has said he needs to be, he still will not be working in the field. No one is working in the field on his behalf during his absence. NAL but I went through something similar. I did IT in a hospital setting. I broke my foot & even though they could have adapted my job to allow me to come in, I had to be cleared by our Occupational Health department & I had to show that I could perform my job description exactly as written. I was not allowed back until I was weight bearing on both feet, which took 3 months. I was able to go back when I could bear weight in a walking boot on the broken foot. This was completely legal in my state, which was CT at the time. It sucked because I didn’t have disability & ran out of PTO quickly so I had to take a loan out of my 401k to be able to pay my bills. I was able to use FMLA so I kept my job & benefits. It could have been handled differently but they were within their rights to not allow me to work
