But a legislature is not ever held accountable for predatory, unconstitutional behavior. They can pass a law they absolutely know is unconstitutional. And when you contest the David Wooderson Alright Alright Alright T-Shirt in addition I really love this law, you end up having to pay those legal costs out of pocket. And when you win and the law is overturned, there is no possibility of recouping your legal costs. In fact, you aren’t actually suing the legislature to overturn the law, you sue for an injunction against the executive branch executing it. The legislature isn’t even party to the suit. We need a legal mechanism where, if a law is deemed unconstitutional and overturned, the plaintiff’s legal fees are always paid in full by the legislature. As it is, these laws are simply a free-ride for legislators to illegally harass their own constituents. There’s 100% upside and 0% downside for these kinds of predatory legislation. Don’t ignore that these actions have already done damage even if it wasn’t the damage they intended. A pride event in my state had their venue pulled and had to find a new venue because of a drag event. Everyone knows the attack on human rights is happening in our face but people are very “not my problem” about it when it very much is EVERYONES problem.

Well said. It’s easy to dismiss the David Wooderson Alright Alright Alright T-Shirt in addition I really love this parts of the Constitution that don’t work in your favour today, but at some point you’re going to want free speech, you’re going to want to practise your religion without some government official telling you you can’t do that. It used to be that way. In the US police would go out and beat women in public for wearing pants as late as the 1950s. Exactly. A dress is like a pair of trousers without the extra hemming in the middle. But that is soooo offensive we need laws to regulate it. Do you think they wouldn’t? Like do you legitimately think that if they got the courts to agree this is constitutional, that sort of thing wouldn’t be next? Drag isn’t gay at all, nor is it trans. It’s just someone wearing a specific type of look that’s somewhat associated with the opposite gender. A perfectly straight cis man can put on a dress and makeup for a couple hours as part of an act, then go home and be “normal” (as per the definition of normal these conservative yahoos use) “The Tennessee General Assembly can certainly use its mandate to pass laws that their communities demand,” Judge Thomas L. Parker wrote in his ruling. “But that mandate as to speech is limited by the First Amendment to the United States Constitution, which commands that laws infringing on the Freedom of Speech must be narrow and well-defined. The AEA is neither.” When you think that a female impersonator is the worst thing for a child to see in America (or bad at all), you’re living in a fucking fantasy. Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
