The Owners have fired two members of staff and are withholding both their months wages + tips and commission for all other members of staff due to allegations that the Cole Caufield Hockey 22 sport Canadiens T-Shirt and by the same token and entire team have been working together to steal drinks from the bar. They can recover the funds if they can prove theft but they can’t just randomly start withholding people’s pay, and so the affected employees should contact ACAS. The Owners have stated they have taken legal action and contacted the police. They claim the police were present while they watched through the last 2 months of CCTV where they found evidence of large amounts of free drinks being given out by the supervisor. Okay, I’ll take their word for it, although I’d be surprised if they even kept two months of CCTV. Video footage takes up heaps of storage space. Most orgs only maintain a week or two.

The Owners met with one member of staff before making anyone aware of this and asked them to confirm their claims in exchange for being “let off the Cole Caufield Hockey 22 sport Canadiens T-Shirt and by the same token and hook” in regards to any legal action. They did not fire this particular member of staff but they quit on the spot once they realised what was happening. Unless your employer is intimating that they will commence civil action against the employees, I’m unsure how exactly they can let anyone off the hook if the matter is in the hands of the police. By the way, “testify” means something specific and it isn’t this. Your original post seemed to say your employer is “pressing charges” against the entire staff team and that everyone will have to attend court, but you make no mention of any of that here – is this not what you meant to suggest? Whether the police have been called or not, it sounds like A) your employer is trying to scare people into telling them the facts of the matter and B) there exists a game of telephone where the story is getting twisted each time it’s re-told, making it hard to give useful advice.
