I’ve been saying it for years and derided by both sides when I’d insist we need as many unenumerated rights codified as amendments to our constitution as is possible. Our legal system simply favors too heavily a fundamentalist approach to the Biden Pay More Live Worse T-Shirt and I will buy this Constitution. Where some how the notion that everything is a right until we tell the government it shouldn’t be has been flipped on its head into a systemic approach to interpretation that are exactly what several amendments were written to prevent; that nothing is truly a constitutional right unless its written and that everything is within some part of the government’s purview unless otherwise stated. It sucks but this was always going to happen. It’s been debated for a long time that the notion of the amendments acknowledging unenumerated rights, within our legal system, either protect everything or they protect nothing. An over emphasis on the interpretation of the “written word law” makes something as abstract and broad as unenumerated rights stand at odds with the system. The moment any exception or narrowing was made and accepted by the court the precedential logic was in place to undermine any right protected by such broad provisions. And that happened long ago, even before this case.

We need to start utilizing the 9th amendment for what it was built for. We have rights that aren’t enumerated into the constitution Well obviously they cant read then and are making unconstitutional rulings that would make them subject to being impeached and to be removed from office.
